Eyefree Assisting Communication Ltd., a company operating under the brand name EyeControl, (“EyeControl”, “us”, “we”, or “our”) operates the https://www.eyecontrol.co.il website (the “Site”).

This Privacy Policy informs you of our policies regarding the collection, use and disclosure of personal Information when you use our Site and the choices you have associated with that Information.

We use your Personal Information for the purposes specified in this Privacy Policy. By using the Site, you give your consent to the collection and use of Information in accordance with this Policy. We hereby inform you, and you hereby acknowledge that you have no legal obligation to provide us with any Personal Information (or any other Information) when you Use the Site, and the provision of it is solely based on your free will. We strongly urge you to read this Privacy Policy CAREFULLY before you start to use our Site and make sure that you fully understand and agree to it. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Definitions

·         “Data Protection Laws” means to the extent applicable, the Israeli Data Protection Legislation, and any other privacy and data protection laws applicable to EyeControl with respect to processing Personal Information, according to the terms of the Privacy Policy.

·          “Information” means Personal Information and Non Personal Information, together.

·         “Israeli Data Protection Legislation” means the Privacy Protection Law 5741-1981 (the “PPL”) and any regulations promulgated thereto, as amended, supplemented and superseded from time to time.

·         “Non-Personal Information” means any information processed by EyeControl in connection with the use of the Site which is anonymous and/or does not personally identify the User and/or reveal the User’s specific identity as an individual, and/or cannot reasonably be attributed to the User (such as your browser type, technical device information, etc.).

·         “Personal Information” means any information processed on the Site, that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual, or as otherwise defined in the Data Protection Laws.

·         “User” means an individual who access and/or uses the Site.

·         The term “Processing” shall have the meanings ascribed to it or to any essentially similar term in the Data Protection Laws.

·         “Services” are any services given by EyeControl in connection with the Site, operated by Eyefree Assisting Communication Ltd.

Information Collection and Use

We collect and Process two types of Information: Personal Information and Non-Personal Information.

Types of Information Collected

Personal Information

While using our Site, we may ask you to provide us with certain Personal information, which may include, but is not limited to:

• email address

• First name and last name

• Phone number

• Your interest in us (as patient, caregiver, clinician, etc.)

• Address, State, Province, ZIP/Postal code, City

• Any additional Personal Information you choose to provide us, through the free text message at the “Contact” tab on our Site.

We may use your Personal Information to:

·         Operate, monitor and improve your use of the Site and provide technical support.

·         To ensure that the Site is functioning correctly and to monitor, investigate any bug with, and improve the Site.

·         Contact you (by e-mail, SMS, or any other available channels) to send general or personalized service-related messages (such as system maintenance notices); provide information you request from us or deal with any enquiries; to contact our Users with updates messages (such as new features and services, etc.); and to transmit newsletters, marketing or promotional materials and other information that may be of interest to you (subject to separate consent if such is required in your jurisdiction or if you sign up to our distribution list on our Site). You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send.

Non-Personal Information

We may also collect information that your browser sends whenever you visit our Site or when you access the Site by or through a mobile device ("Usage Data").

Cookies and Information Collected by Other Automated Means

Retention of Information

We retain the User's Personal Information for as long as such individuals are using our Site. If a User ceases to use our Site, we may continue to retain certain Personal Information of that User for the period required by our legal and regulatory obligations and/or for accounting purposes (i.e., as required by applicable laws regulating our Services, for bookkeeping purposes, and in order to have proof and evidence concerning our relationship with that User, should any legal issues arise following the User’s discontinuance of use of our Site).

Please note that except as required by applicable law, we will not be obligated to retain your information for any particular period, and we are free to securely delete it for any reason and at any time, with or without notice to you.

Unless otherwise restricted by applicable law, Non-Personal Information may be retained indefinitely.

Disclosure of Information

Service Providers and Business Partners

We may engage selected third party companies and individuals to perform services on our behalf (such as cloud vendors, data hosting services, data analytics services, e-mail distribution and monitoring services, research and development services, nurses and physicians, and our business, legal, financial and compliance advisors). We only provide such service providers with Information so they can perform their required functions on our behalf.

Affiliates

Your Personal Information may be shared with any of our affiliates where we consider that it is in our legitimate interests to do so for internal administrative purposes (for example, ensuring consistent and coherent delivery of Services to our Users, corporate strategy, compliance, auditing and monitoring, research and development and quality assurance).

Business Transaction

We may share Information in connection with any proposed or actual financing, reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).

Health Organizations and Medical Clinics

If the Device is installed and used by a Health Organization or Medical Clinic, we may share your Information with such entities in order to use the Device and for them to provide you with their medical services (for which we are not responsible).

Where appropriate, we will limit sharing of your information in accordance with the choices you have provided us and applicable law.

Your Rights

You may have the right to review your Personal Information that is stored in our database(s) and provide a request for update, amendment and/or deletion if it is inaccurate or incorrect, by contacting us at hello@eyecontrol.co.il. We will act in accordance with the applicable Data Protection Laws in order to comply with your request. However, we may retain certain Personal Information as deemed required by and/or as otherwise permitted by applicable law (including Data Protection Laws). Your rights may differ depending on your jurisdiction.

When you ask us to exercise any of your rights under this Privacy Policy and the Data Protection Laws, we may need to ask you to provide us certain credentials to make sure that you are who you claim you are, to avoid disclosure to you of Personal Information which is related to others that you are not authorized to receive, and to ask you questions to better understand the nature and scope of Information that you request to access.

Subject to the provisions set forth above, you have the right to withdraw your consent to receive marketing materials, by contacting us through the “unsubscribe” instructions in the promotional communications you receive.

Our Service may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Children's Privacy

The Site is directed towards and designed for use by persons aged 18 and older, depending on the minority age in your jurisdiction. We do not solicit or knowingly collect Personal Information from children under the age of 18. If we nevertheless receive Personal Information from an individual who indicates that he or she is, or whom we otherwise have reason to believe is, under the age of 18, we will endeavor to delete such information from our systems. If you are an individual under the age of 18, you are required not to Use our Site.

Changes to This Privacy Policy

This Privacy Policy may change from time to time. If we decide to change our Privacy Policy, we will post new privacy policy on our Site accompanied with a notice indicating that some changes have been made. The new privacy policy will be effective from the date mentioned at the top page of the new policy.
